10 WARRANTY AND AFTER SALES SERVICE
WARRANTY
MG International warrants this (Swim Alert

) product (the “Product”) against any defects in materials and
workmanship and shall provide warranty services and/or replacements during the periods stipulated below,
beginning from the date of first purchase:

Any consumables (e.g. batteries, dehydrating sachets, magnets, etc.) included in the original Product –

In addition to the warranty exclusions noted below, this warranty does not apply to normal discoloration, fading,
or minor deteriorations of exterior surfaces resulting from exposure to the elements, except to the extent that the
Product’s intended performance is affected thereby.
Replacement or repair of any defective part or Product will not extend the applicable warranty period.
If any fault or defect with the Product arises, the following steps must be taken:
(i)

Notify MG International of the Product model number, serial number and details of the defect. On
receipt of this information, MG International will provide service data or shipping instructions for defects that
meet the warranty criteria; and

before any repairs are made.
MG International’s sole liability for any defective Product is limited solely to MG International repairing or
replacing any Product or part thereof pursuant to this warranty. MG International reserves the right to replace
any repairable parts with new or refurbished parts. In no event shall MG International be held responsible for
any other costs, charges, expenses, losses or damages (direct, indirect, incidental, special, exemplary,
consequential , or otherwise), of any kind whatsoever arising out of a defective Product.
DURING ANY PERIOD IN WHICH THE PRODUCT IS DISABLED, WHETHER DUE TO DEFECT
OR OTHERWISE, THE PURCHASER IS ADVISED TO INCREASE ACTIVE PERSONAL
MONITORING AND SUPERVISION OF THE POOL AREA.
WARRANTY EXCLUSIONS
The warranty does not apply to any Product (i) that is not installed in compliance with the applicable Product
documentation; (ii) for which the user does not successfully perform any installation tests, and subsequently
conduct regular maintenance and tests, as required in the applicable Product documentation; or (iii) on which the
original identification marks have been removed or modified or the warranty sticker (inside the Product) is
damaged. Further, this warranty and does not apply to, and MG International shall not be liable for: (i) any
defect in, or failure of, the Product resulting from an accident, shock, negligence or misuse; (ii) any defect in, or
failure of, the electrical supply to the Product; (iii) damage or defect due to lightning or other Acts of God; (iv)
any defect of, or caused by, parts not supplied by MG International; (v) degraded or corroded components due to
prolonged immersion of the Product in water other than as specified in the applicable Product documentation;
(vi) modification, adjustment, repair, disassembly or maintenance performed by any party other than MG
International or its approved subcontractors and retailers; or (vii) due to any other cause which does not result
from a defect in materials and workmanship .
WARRANTY DISCLAIMERS
EXCEPT FOR THE WARRANTIES SET FORTH ABOVE, MG INTERNATIONAL HEREBY DISCLAIMS
ANY AND ALL REPRESENTATIONS AND WARRANTIES OF ANY KIND, EXPRESSED OR IMPLIED,
WHETHER ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE, INCLUDING, WITHOUT
LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
PURPOSE AND NON-INFRINGEMENT.
MG International’s sole liability for any defective Product is limited solely to MG International repairing or
